Nintendo Partners Up With a Major League Baseball Team
Nintendo, owner of Major League Baseball's Seattle Marniers, has decided to bring some of its technology to the ballpark. Baseball fans can now go to Safeco Field and use their Nintendo DS for more than just video games. Users pay a fee to hook their DS up to the network at the stadium and then they can access up to the minute stats, view replays, and even order food from various concession stands around the stadium. Fans seem to enjoy this feature. The one drawback to this idea is a bit of a legal one. Most people know that when you attend a baseball game you assume the risk of being hit with a foul ball. However, some lawyers have found a way around this and a couple have successfully sued using "Attractive Nuissance" as the basis to their case. Attractive nuissance is when an organization creates a distracting promotion that is meant to capture the attention of the fans. If a fan is paying attention to their Nintendo DS and they get hit with a foul ball, will they be able to successfully sue by using attractive nuissance? This has yet to be seen but it should be interesting to find out the verdict. So, if you cannot pull yourself away from your Nintendo DS long enough to watch a ballgame, just bring it with you to the ballpark!
